The Website is operated and owned by Sanman Society (Sanman or the Society), a society registered with the Registrar of Societies, Government of Karnataka and headquartered in Bangalore.
Your use of the Website constitutes your acceptance of and agreement to be bound by these Terms of Use. If you do not agree to these Terms of Use, please do not access or use the Website.
The Terms of Use are subject to revisions at any time, as determined by Sanman, without notice, and any such changes are effective immediately upon being posted on the Website; any use of the Website thereafter will be deemed to be an acceptance of these changes by the User. Users are strongly urged to read the Terms of Use in their entirety and to periodically check this page for modifications or revisions to the Terms of Use. Sanman shall not be responsible for any User’s failure to remain informed about such changes.

Use of the Website is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. If you are a minor i.e. under the age of 18 years, you shall not register as a User and shall not transact on or use the Website. However, you may use the Website under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. The Society reserves the right to cancel or refuse your registration and / or refuse to provide you with access to the Website if it is brought to the Society’s notice or if it is discovered that you cannot form legally binding contracts.
REGISTRATION
You can access all the features on the Website by registering yourself as a volunteer. Please keep your account and registration details updated so that we can process your requests without any delay or inaccuracy.
As part of the registration process on the Website, the Society may collect certain personal information about you. Information collected about you is subject to the Privacy Policy of the Society, which is available at Click Here. You have the option to refuse to provide this information, however, should you do so, you may not be able to access the full range of services available on the Website.
You may not transfer your username or account to any other person.
LICENSE AND ACCESS
By accessing the Website, you agree that you will not scrape or attempt to scrape or extract any data, including information provided by third parties or other users of the Website. You also agree that you shall not use the Website for any monitoring, benchmarking or throttling or any other purposes that may impair the performance or functionality of the Website. You agree not to access or attempt to access any content available on the Website by any means other than through the interface that is provided by Sanman.
You agree that while using the Website, you shall not post, upload, publish, transmit or share any material or information that: (a) belongs to another person and to which you do not have any right to; (b) is grossly harmful, harassing, blasphemous defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; (c) harms minors in any way; (d) infringes any patent, trademark, copyright or other proprietary rights; (e) violates any law for the time being in force; (f) deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature; (g) impersonate another person; (h) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; (i) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation. Any violation of this clause may lead to suspension of your account and/or your use of the Website. In the event, the Society receives any complaint that any information posted by you amounts to a breach of this clause, the Society will take such steps necessary as required under law to remove or disable access to such information and may suspend or terminate your account and/or access to the Website at its sole discretion.
DISRUPTION
Sanman makes no guarantee as to availability, quality or service levels of the services available on the Website on a 24×7 basis, or promise uninterrupted access to the Website. However, disruption of services may arise due to technical or operational difficulties, and no prior notice of downtime will be given to you in such circumstance. Sanman may also suspend the access of the Website for specific Users permanently or temporarily for any reason whatsoever, including while investigating complaints or alleged violations of these Terms of Use or the Privacy Policy, or disable access to the Website for such User.
OTHER TERMS AND CONDITIONS
(i) You will use the Website for lawful purposes only, and comply with all applicable laws and regulations while using the Website.
(ii) You will provide authentic and true information in all instances where any information is requested of you.
(iii) If at any time, the information provided by you is found to be false or inaccurate (wholly or partly), the Society shall have the right in its sole discretion to debar you from accessing the Website in the future without any prior intimation whatsoever, and without any liability to you.
(iv) You are accessing the Website at your sole risk.
INTELLECTUAL PROPERTY RIGHTS
The Website contains videos, photographs, copyright free images from third party websites, photos taken by Sanman volunteers, artwork, graphics, audio clips, logos, comments, data, text, software, scripts, projects, other proprietary material and information, and associated trademarks and copyrightable works owned by Sanman or its licensors. Except for that information which is in the public domain or for which you have been given permission, you agree not to copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. Access to or use of the Website does not confer and should not be considered as conferring upon anyone any license to the Society’s or any third party’s intellectual property rights. Any use of the Website or its contents without the permission of Sanman is prohibited.

All trade names/ trademarks indicated on the Website are trade names / trademarks of Sanman, unless otherwise specified. All other trademarks not owned by Sanman that appear on the Website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Sanman.
THIRD PARTY USE
We do not guarantee that other Users of the Website will comply with these Terms of Use. You hereby assume all risk of any harm or injury which may result to you on account of such non-compliance by third party Users. The Society shall not be held responsible for any such harm or injury resulting from third party use. You hereby agree to use the Website at your sole risk and judgment and acknowledge that the Society shall not be responsible for any content that may be deemed offensive, indecent, or objectionable to you.
The Society does not guarantee the content of any third party sites and does not make any representations regarding the content or accuracy of material on such sites. If you access a link of any third party website, you hereby acknowledge that you do so entirely at your own risk and expense.
THIRD PARTY DISPUTES
Any dispute between you and any other third party arising out of the use of the Website shall not be the responsibility or liability of the Society. Sanman shall not be held liable for any negligent conduct or behaviour, whether actions or omissions, of any third party in relation to the use of the Website. Sanman encourages you to report any complaints about the Website to Sanman by contacting the Grievance Officer, and Sanman shall take appropriate action as soon as reasonably practicable.
INDEMNITY
You hereby agree to keep and hold the Society, its members, associates, directors, officers, employees, volunteers and agents, fully indemnified and harmless from and against all claims, proceedings, penalties, damages, losses, actions, costs and expenses arising out of or in relation to the use of the Website by you or your breach of these Terms of Use or violation of any law, rules or regulations or the rights of a third party or any breach of your representations and warranties set forth above and/or any fraudulent act on your part. The Society’s right to be indemnified shall survive the expiry or termination of these Terms of Use between you and the Society.
LIMITATION OF LIABILITY
Sanman disclaims any liability as to the accuracy, completeness, reliability, fitness, availability or relevance of any information.
You hereby acknowledge and agree that in no event will the Society be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, reputation, goodwill, business opportunities, data or other intangible losses or be liable for any loss or damages of any kind whatsoever arising out of the use of or inability to use the Website, however arising whether by tort or by contract, including without limitation, damages for loss or corruption of data or programs and service interruptions, even if the Society knows or has been advised of the possibility of such damages. The Society hereby also disclaims any and all liability for the acts, omissions and conduct of any third parties in connection with or related to the use of the Website. Sanman shall not be responsible or liable for any damages or losses resulting from any correspondence or business dealings with third-party service providers or advertisers or resulting from the presence of such advertisers on the Website.

SANMAN PROVIDES ACCESS TO THE WEBSITE ON AN “AS IS" BASIS AND GRANTS NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WITH RESPECT TO THE WEBSITE. THE SOCIETY SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. YOU EXPRESSLY AGREE THAT THE USE OF THE WEBSITE IS AT YOUR OWN RISK.
TERMINATION
Any violation or breach of the Terms of Use may lead to automatic suspension or termination of your account or access to the Website by the Society, and the Society shall not be responsible or liable for any refunds or damages in this regard.
The termination of the Terms of Use will not affect any liability that may have arisen under the Terms of Use prior to the date of termination.
DONATIONS
All the donations received via the offline or online donation options as provided on this Website are used for charitable purposes only. 50% of the donations are tax deductible under Section 80G of the Income Tax Act, 1961. Donors who want a tax receipt need to provide details as required in the Donation Options page. Donations received are not refunded. GOVERNING LAW & DISPUTE RESOLUTION
These Terms of Use shall be governed by the laws of India and any disputes or proceedings arising hereunder shall be subject to the jurisdiction of the courts in Bangalore.
